Group Ibex Zone Terms, Conditions and Privacy Policy

 TERMS AND CONDITIONS

 

1. Reservations & Payments

1.1. Reservations can be made by contacting Group Ibex Zone, or through your booking agent. A deposit of 50% of the total amount is required to confirm your booking. The balance of the remaining 50% must be transferred to Group Ibex Zone forty five (45) days prior to you arrival.
1.2. Hunts are booked and confirmed only upon receipt of a 50% deposit. This deposit is due within fifteen (15) days of making the reservation. There shall be no binding contract until the deposit has been paid. Failure to remit your deposit on time may result in an automatic release of the confirmed dates and the possible inability of re-instating your reservation. When Group Ibex Zone acknowledges receipt in writing of the deposit to you, it shall be deemed to constitute acceptance and confirmation of the reservation.
1.3. The remaining balance is due no later than forty five (45) days prior to commencement of your hunt. If the balance has not been received by that date, Group Ibex Zone shall be entitled at its discretion to treat your reservation as cancelled and consequently to forfeit such part of the deposit as determined solely by Group Ibex Zone.
1.4. Any reservation made within forty five (45) days of commencement of your hunting may be accepted provided space is available, payment in full is received, and documents can be delivered prior to departure.
1.5. The total amount must be paid before the beginning of the hunt, if not, nothing can be arranged. At the end of the hunt, the total final payment must be paid in cash.
1.6.This is the general way we use regarding booking and payment, however we can arrange this in a special and particular form in the customer’s contract.

2. Cancellations & Refunds

2.1. Any cancellation of a reservation must be made in writing and shall only be effective upon its acknowledged receipt by Group Ibex Zone. Cancellation charges will be applied in the following circumstances:
a – In case of cancellation, the client is fully responsible for paying all the permit, insurance and license hunting costs which may be issued in his name.
b – Cancellation 46 days prior to the hunt start date, the full deposit is refunded less a 1000 € handling fee per hunting client.
c – Cancellation 45 to 31 days prior to the hunt starting date, the 50 % deposit is forfeited.
d – Cancellation 30 days or less, the 75 % hunt cost is forfeited.
2.2. If the client is a “no show”, Group Ibex Zone shall be entitled to treat the reservation as cancelled without the client having given Group Ibex Zone any notice, and the provisions of paragraph 2.1 (a,b) shall apply. Also, any carry over for the following year shall be at the option of Group Ibex Zone.
2.3. Any request to vary your reservation must be in writing, and Group Ibex Zone’s agreement to request shall be at its sole discretion. If Group Ibex Zone agrees to vary your reservation as requested, it reserves the right to charge of an administration fee which shall be presented to you in writing and which is payable no later than seven (7) days after such notification.
2.4. No refunds are given:
-For lost travel time, or for substitution of facilities, areas, hunters, camps and dates.
-For itineraries amended after departure.
-Air circumstances arising beyond Group Ibex Zone ´s control, necessitating that alternative arrangement must be made to ensure the safety, further participation, and/or enjoyment of your hunting.
-If you do not appear for any accommodations, service, sightseeing or trip segment without notifying Group Ibex Zone, or if you leave your hunting after it has begun, and miss any scheduled sightseeing, activities or accommodations.
2.5. This is the general way we use regarding cancellations and refunds, however we can arrange this in a special and particular form in the customer’s contract.

3. For Your information

3.1. Group Ibex Zone acts as booking agent for hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners and other independent contractors providing accommodations, transportation, and/or other services. Each of these companies is an independent corporation with its own management and is not subject to the control of Group Ibex Zone including, but not limited to various ground operators.
3.2. Group Ibex Zone accepts all bookings like those described above. Transportation, accommodations, and other services provided by the ground operators are offered subject to the terms and conditions contained in the tickets, exchange orders, or vouchers issued by them and/or their suppliers. Because Group Ibex Zone does not have the right to control the operations of the independent operators and their suppliers, it cannot be liable for any personal injury or property damage which may arise out of these services. Group Ibex Zone reserves the right to cancel any itinerary, or any part of it, to make such alterations in the itinerary as it deems necessary or desirable, to refuse to accept or to retain any expenditure occasioned by delays or events beyond its control. In case of any appreciable variation in its cost, Group Ibex Zone reserves the right to adjust its rates.

4. Risks

4.1.Hunting activities are potentially dangerous. The operating company, outfitter, and team will apply the necessary measures to preserve the customers’ safety, however they are not responsible for any accident, loss, illness, or physical conditions that might occur during the activity, as well as for any alteration, delay, or cancellation due to climatological conditions or unforeseen circumstances, and Group Ibex Zone won’t accept any extra expense that might arise from such conditions.
4.2. Group Ibex Zone draws your attention to the fact that there are certain inherent risks involved in participating in the type of trip sold by Group Ibex Zone, and that you accept them at your own risk.
4.3. It is your sole responsibility to take all appropriate medical advice prior to departure as to whether you are fit enough to take the trip booked. Group Ibex Zone shall not be liable for illness, injury, or death sustained on a program sold by Group Ibex Zone which is not due to the gross negligence of Group Ibex Zone, its officers, employees, authorized representatives, or agents whomsoever.

5. Force Majeure

5.1. “Force Majeure” means, in relation to Group Ibex Zone, any circumstances beyond the reasonable control of Group Ibex Zone (including, but not limited to: acts of God, explosion, flood, tempest, fire, accident, war, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences).
5.2. If Group Ibex Zone is affected by Force Majeure, it shall be entitled to and may, in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by Group Ibex Zone to you as a result of the non-performance of any of Group Ibex Zone ‘s obligation here under shall remain in its sole and absolute discretion although Group Ibex Zone shall use reasonable endeavours to reimburse you where possible. However, Group Ibex Zone shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to Group Ibex Zone of the Force Majeure.

6. Insurance

Group Ibex Zone obtain the basic insurance that that the spanish law say to get the hunting license.

7. Import Permits & Trophy Shipment

Trophy shipment can take from 3 to 6 months. The client is fully responsible for getting the necessary import permit for his county. If within 9 months payment has not been arranged, the trophy will become property of Group Ibex Zone.

8. Terms & Conditions

These terms and conditions govern the relationship between Group Ibex Zone and client, to the total exclusion of any other terms and conditions. No alteration to the terms and conditions may be made by any of our employees, authorized representatives, or agents, unless in writing by an authorized officer of Group Ibex Zone. An authorized officer of Group Ibex Zone shall make all decisions and matters subject to Group Ibex Zone’s discretion.

9. Carriage by Land, Sea & Air

Carriage by Land, Sea and Air is subject to the terms and conditions of the carrier with whom you travel and to international conventions, some of which may limit liability. Land, sea, and air travel are also subject to operational decisions of carriers as well as air and sea ports which may result in cancellations, delays, or diversions, over which Group Ibex Zone has no control and for which Group Ibex Zone accepts no liability whatsoever.
Baggage: Temporary or permanent loss of baggage is the responsibility of you or the carrier.

10. Travel Documents & Vaccinations

It is your responsibility to ensure that passports, visas, travel permits, health certificates, inoculations, or other documentation required for the trip are obtained and are in order. It is your responsibility to meet any additional costs incurred either by yourself, or by Group Ibex Zone on your behalf, as a result of any failure by you to comply with such requirements.

11. Special requests

You must advise Group Ibex Zone in writing of any special requests, e.g. diet or facility, when you submit your reservation to Group Ibex Zone. If possible, Group Ibex Zone will meet any such requests.

12. Information in the Brochure

All information given in Group Ibex Zone’s brochure is, to the best of Group Ibex Zone ‘s knowledge, correct at the time of going to press, however Group Ibex Zone reserves the right to change the same. The photographs reproduced and information provided in the brochure depict typical scenes experienced and details on each destination; but the subject matter may not necessarily be seen or experienced while visiting that destination.

13. Photography

Group Ibex Zone reserves the right, without further notice, to make use of any photography or film taken on the trip by our staff for general purposes without payment or permission. When a client makes available to Group Ibex Zone photographs of their own, Group Ibex Zone reserves the right to make use of such photos.

14. Consent

The payment of the deposit or any other partial payment for a reservation on a hunt constitutes consent to all provisions of the conditions and general information contained in Group Ibex Zone’s brochure and price list. The terms under which you agree to take these hunts cannot be changed or amended, except in writing and signed by an authorized officer of Group Ibex Zone.

15. Money Paid to Booking Agents & Bookings Agent’s Responsibility

Your booking agent will forward deposits and other payments to Group Ibex Zone on your behalf. Since your booking agent is not our agent for the purpose of receipt of monies, there is no liability on your part unless and until we notify you (by way of a booking confirmation) that payment has been received by us. We will issue a booking confirmation to your agent immediately upon receipt of their payment on your behalf.

At Group Ibex Zone, we are very proud of our relationship with booking agents. To facilitate the reservation process for you, Group Ibex Zone requests its booking agent provide you with thorough communications pertaining to your booking. Your agent has been provided with a list of responsibilities to assist and inform you on matters such as required documentation, payment schedules, and cancellation policies. Your agent will assist you to the best of his/her ability in providing answers and information pertaining to your booking.

16. Conditions of Booking

You shall comply with the instructions of Group Ibex Zone ‘s representatives at all times. No client shall be accepted or permitted to continue to hunt while their mental status or physical condition is, in the opinion of any representative of Group Ibex Zone, such as to render them incapable of caring for themselves, or makes them objectionable to other clients, or becomes a hazard to themselves or other clients, and Group Ibex Zone will not be responsible for expenses by such persons precluded from completing the safari for this reason.

17. Notice of Enforceability

Please remember: When you book travel related services with Group Ibex Zone, you are entering into a binding agreement that assumes all terms and conditions are fully understood as stated Group Ibex Zone’s brochure and price list.

18. Changes

All trophy and daily fees, as well as terms and conditions, are subject to change without notice, Group Ibex Zone is not responsible for these kinds of changes, and client accepts possible trophy fee increases by the game department.
All offers are subject to prior change without notice by the competent authorities. Each hunter must bring the official documentation.
Any change in the conditions mentioned above, will be shown in the corresponding offer. Any surcharge we will comment you in advance.

19. Things about hunting

All wounded and not found animals (with blood) must be paid for completely.
If the client misses to shoot a trophy 3 times, he will have to pay the 50% fee as well.
If finally the customer decides not to shoot the animal contracted, or the animal the guide is indicating, he will have to pay the trophy fee completely.

20. Spanish law

The parties will submit expressly to the Courts of Spain, and specifically to the Courts of the city of Castellón (Spain), with full subjection to Spanish law. Renouncing expressly any other jurisdiction and law that could correspond. Regarding the application of the terms and general conditions of this contract, both parties by common consent grant full application to this agreement.
